Residential eviction — notice to quit
Situation overview
James Cole occupies a 3-room flat in Lyon 3rd since 12 January 2022 under a residential lease with SCI Horizon Est. Monthly rent is €980 plus €120 charges. The entry inventory was drawn up the same day.
From November 2023, payment delays appear. SCI Horizon Est sends amicable reminders in January and February 2024 for an alleged rent and charges balance.
Email exchanges between the agency and the tenant concern the account detail, allocation of partial payments, and a request for a repayment plan. Positions still diverge on the exact amount due.
A formal notice is served on 8 February 2024, inviting regularisation within a deadline before any proceedings. The tenant disputes part of the account in writing and attaches earlier receipts.
An action for lease termination is brought; proceedings lead to a judgment setting termination in principle and a rent-debt schedule, subject to enforcement.
On 12 March 2024 a notice to quit is served. It announces a €2,840 balance and opens a regularisation period. Two partial payments follow: €300 on 14 March and €400 on 18 March 2024.
On 20 March 2024 an email again disputes the account, asks for allocation detail of the transfers, and mentions a CAF housing-support application.
At this stage the February 2024 receipt is on file; March is missing. The exact balance after allocation, the scope of any resolutory clause, and the possible effect of housing aid remain to be clarified.
The current situation is therefore a documented pre-litigation phase: lease documents gathered, partial payments traced, material uncertainties on balance and deadlines — without a definitive conclusion on the outcome.
What the law says
What, in law, supports your position
Documented partial payments after the notice, written dispute of the account, and continuous receipts through February 2024 may support regularisation or a debate on allocation (French residential lease framework).
See the 3 legal sourcesWhat, in law, may support the other side
The formal notice served and the announced balance not fully cleared may support proceedings if the deadline expires unfruitfully, especially with a resolutory clause under French residential lease formalities.

Documented pre-litigation phase. The formal notice is running; partial payments and the account challenge are on file; residual balance and deadlines remain open.
Your situation facing the law
Where does your case stand?
Documented pre-litigation phase after the formal notice. Lease, account statement, notices, summons, judgment, vacate order and partial-payment evidence are referenced in the file.
Moving your case forward
Complete the March receipt; obtain the allocation detail for the €700; clarify housing-aid status; keep a written trail — illustrative steps, not certified strategy.
